Terms of Service

Version 1. Effective [DATE]. These terms are an agreement between you and [OPERATOR NAME] (“we”, “us”), which operates Pensum. Questions: [CONTACT EMAIL].

1. Who can use Pensum

You must be at least 18 years old and able to form a binding contract. Pensum is not directed to children and we don’t knowingly collect information from anyone under 13. You sign in with a Google account and are responsible for keeping that account secure and for activity under it.

2. Early access, pricing, and paid plans

Pensum is in an early access period. Features, limits, and pricing may change, and we may introduce paid plans. Before any change to pricing that affects you, we will give you at least 30 days’ notice by email or in the app. You will never be charged unless you choose a paid plan, and you can export or delete your data at any time. During early access the service may occasionally be unavailable.

3. Your data

You own the information you put into Pensum, including budgets, accounts, and transactions. You give us permission to store, process, and display it only as needed to provide Pensum to you and to the people you choose to share budgets with. We don’t sell your data or use it for advertising. Our Privacy Policy explains what we collect and how we protect it. You can download a copy of your budgets and delete your account from Settings.

4. Sharing

If you share a budget, the people you invite can see it, and editors can change it. Owners control who has access. You’re responsible for whom you invite.

5. Acceptable use

Don’t misuse Pensum. For example, don’t try to access other people’s data, probe or disrupt the service, get around limits or security, upload malicious files, use automated means to create accounts or overload the service, or use Pensum for anything illegal. We may limit, suspend, or end access for violations, and we’ll tell you why unless the law or security concerns prevent it.

6. Not financial advice; not a bank

Pensum is a budgeting tool. It does not provide financial, investment, tax, or legal advice, and nothing in it is a recommendation. Pensum is not a bank and doesn’t hold or move money. If you choose to turn on bank sync, Pensum receives read-only transaction data through SimpleFIN, an independent service you sign up for and pay directly; SimpleFIN’s own terms apply to it, and Pensum never receives your bank login. Information you import from bank files may be incomplete or wrong; check important figures against your financial institution.

7. Account limits

We may set reasonable limits, such as how many budgets an account can own, and may change them. If a limit goes down, you keep what you already have but may not be able to add more.

8. Ending your use

You can stop using Pensum and delete your account at any time. We may suspend or close accounts that violate these terms, or stop offering Pensum; if we stop offering it, we’ll give at least 30 days’ notice so you can export your data.

9. Disclaimers

Pensum is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we don’t promise the service will be uninterrupted, error-free, or that data will never be lost. Keep your own copies of anything important.

10. Limitation of liability

To the fullest extent the law allows, we won’t be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Pensum. Our total liability for any claim related to Pensum is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you.

11. Changes to these terms

We may update these terms. For material changes, we’ll ask you to review and accept the new version in the app, and if the change affects paid plans or your rights significantly we’ll give at least 30 days’ notice. If you don’t agree, you can stop using Pensum and delete your account.

12. Governing law

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah, except that either of us may bring a claim in small claims court where eligible. Nothing here limits rights you have under the consumer protection laws of the place you live.

13. Other terms

If part of these terms can’t be enforced, the rest still applies. Not enforcing a provision isn’t a waiver. You can’t transfer these terms without our consent; we may transfer them as part of a reorganization or sale of Pensum, with notice to you. These terms and the Privacy Policy are the whole agreement between us about Pensum.
